BV9500 DEAD! No power, no charging, clicking

Ok so my shiney new BV9500 arrived a few days ago, I powered it up, put its screen protector on, what an awesome phone.
I've had a BV5000 until now which is why I spent money on an upgrade, that too was a great phone.
It worked fine for about 4 hours, battery was at 70% and I was loving the new interface etc.
Then all of a sudden, I was mid phone call and it just died
It wont power back on, it wont charge, it's a $400 brick.
Now I understand it's chinese new year and all that jazz, but I am being told it will be a long time before I get an answer to my problem.
(I know the problem, I can hear clicking if you put the phone right up to your ear, the mainboard (specifically the power section) is dead. I come across it all the time in equipment repairs).
So for the next 7 days, it's under credit card protection. I don't believe I'm going to get a resolution before that, so do I go through the process of reversing the payment? I fear that if I let that protection expire, I'm left with a dead phone and no refund.
I've bought about 12 blackviews for other people/ work mates etc in the past, none have had issues, but if this leaves a bad taste in my mouth I may have to go back to nokias in a rugged case.
What are peoples thoughts?
